Terms and conditions

1. Publisher
Halofloor is a project under development, published on a non-professional basis. The publisher can be reached at contact@halofloor.com.
Under article 6 of the French law on confidence in the digital economy, a non-professional publisher may withhold their personal contact details from public display provided they have supplied them to their hosting provider, who keeps them available to the judicial authority. The hosting provider's identity is available on request at the contact address. These details will be completed when the service goes on sale.
2. Purpose
Halofloor is an online service that displays visuals computed in real time from the music you are listening to. It runs in a browser, with no installation. These terms govern access to and use of the service; using it means accepting them.
3. What the service does, and does not do
Halofloor does not supply music and does not resell any. It reads what your device is already playing, from your own subscriptions or from freely available radio streams. Your relationship with your music provider remains between you and them, including their own terms, availability and pricing.
The service depends on interfaces supplied by third parties. If one of them changes or closes its access, the corresponding feature may be reduced or cease, without this amounting to a failure on our part.
4. Account
Creating an account requires a valid email address and commits you to keeping it confidential. You are responsible for actions taken from your account. Tell us without delay in the event of unauthorised use.

Prices are shown in US dollars and exclude any sales tax or VAT that may apply in your country, which is added at checkout. Subscriptions are annual and renew automatically unless cancelled before the renewal date. Any price change is announced at least thirty days in advance and applies only from the following renewal.
6. Right of withdrawal
If you are a consumer in the European Union, you have fourteen days from subscribing to withdraw, without reason or penalty. By requesting immediate access to the service, you agree that performance begins before the end of that period; you keep your right of withdrawal, and the refund is reduced in proportion to the period already used.
The free plan exists precisely so you can try the service before paying.
7. Cancellation
You may cancel at any time from your account. Cancellation takes effect at the end of the current term: you keep access until then, and no further payment is taken. We may for our part suspend an account in the event of a serious breach of these terms, after informing you, except in an emergency or where the law requires otherwise.
8. Acceptable use
You undertake not to:
- circumvent the limits of your plan, or share access beyond what it provides;
- attempt to extract, copy or redistribute the visual worlds or the service's code;
- use the service to infringe a third party's rights;
- disrupt its operation, in particular through massive automated requests.
9. Public performance and music rights
Using Halofloor in a bar, at an event or in any place open to the public amounts to public performance of music, which is subject to copyright whether you use our service or not. It is for you to obtain the authorisations and pay the royalties due to the relevant collecting society in your country — in France, SACEM. Our Pro plan permits this use as far as we are concerned; it does not exempt you from those obligations.
10. Intellectual property
The service, its code, its visual worlds and its brand belong to us or are licensed to us. Your subscription grants you a personal, non-exclusive and non-transferable right of use for the term of the plan taken out. Album artwork and recordings remain the property of their respective rights holders.
11. Availability
We strive to provide a continuous service, without guaranteeing uninterrupted availability. Interruptions may occur for maintenance, updates or because of a third party. Planned work is announced where possible.
12. Liability
The service is provided as is. We cannot be held liable for indirect damage, nor beyond the sums you have paid us over the twelve months preceding the triggering event. None of these limitations sets aside the statutory guarantees available to consumers, in particular the guarantee of conformity.
13. Changes to these terms
These terms may change. Any substantial change is notified to you at least thirty days before it takes effect; if you disagree, you may cancel free of charge within that period.
14. Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will first be sought at contact@halofloor.com. Failing that, a consumer may refer the matter free of charge to a consumer mediator, whose details will be published here when the service goes on sale, or to the European online dispute resolution platform. The competent courts are those of the defendant's domicile or of the place of performance, at the choice of a consumer claimant.
